Refugee Appeal Board

The Refugee Appeal Board is established under Section 9 of the Refugees Act, 2006(repealed), and is mandated to hear and determine appeals against decisions of the Commissioner for Refugee Affairs. This aforementioned mandate is preserved by Section 43 of the Refugees Act 2021 (also known as the transitional provisions).

Appeal Process

  1. Appellant files appeal at the Refugee Appeal Board (RAB) within 30 days of receiving the Commissioner for Refugee Affairs' (CRA) decision
  2. Registrar receives the appeal and issues the Appellant an Appointment Slip
  3. Registrar serves the Commissioner for Refugee Affairs within 7 days of receiving appeal case
  4. Commissioner for Refugee Affairs files response within 21 days of being served
  5. Appeal Case is heard and determined by the Refugee Appeal Board within 180 days   
  6. Refugee Appeal Board decision issued either confirming or setting aside Commissioner for Refugee Affairs' decision​
